UN Compilation:
Para 70) [CEDAW] remained concerned at the prevalence in Ukraine of violence against women, in particular domestic and sexual violence, which remained underreported. While noting that the bill on the ratification of the Istanbul Convention was undergoing a second reading in Parliament, it was concerned that domestic violence had not been criminalized and that there was no specific definition of gender-based violence in the domestic legislation.
Stakeholder Summary:
Para 5) The recommendations on the necessity of ratification of the Council of Europe (CoE) Convention on preventing and combating violence against women and domestic violence (Istanbul Convention), improvement of legislation on combating domestic violence and issues of ensuring equal rights and opportunities for women and men had not been fully implemented.
Para 68) JS4 reported that Ukraine still did not have a specific crime of domestic violence, though noting that a proposed package of laws to address violence against women, including a new domestic violence law, passed the first hearing in 2016 in Parliament. However, the legislative package was returned to the Working Group because it contained references to gender and sexual orientation. JS4 added that the ongoing conflict in eastern Ukraine had exacerbated the problem of domestic violence. JS15 stated that it was difficult to collect data on sexual and gender-based violence associated with the on-going conflict.
Para 69) JS4 noted that Ukraine fell short of complying with international standards on victim services, and there were no centres for victims of rape, sexual assault, domestic violence or trafficking. -

Type:Review DocumentationSession:2nd session, May 2008Status:N/AContents:There is still an acute need for a broad and effective awareness raising as one of the
most important measures for preventing HIV/AIDS and promoting tolerance towards the
infected, and consensus building among all stakeholders.
Additional problems in this area include violations of the rights of people infected with
HIV/AIDS. In particular, there have been a number of reports of violations of the rights of
HIV-infected inmates in prison medical units of the State Department of Corrections. In an
overwhelming majority of oblasts, local administrations do not provide funding in their budgets for the local HIV/AIDS prevention program and treatment of HIV-infected children is inadequate. [Paras 83, 84] -

Type:RecommendationSession:14th session, November 2012Status:RejectedContents:Enact legislation that explicitly protects LGBT persons from discrimination and ensure that laws that contain discriminatory provisions against LGBT persons are amended.ExplanationNational legislation establishes the principle of non- discrimination, which provides equal rights and liberties for all persons, groups of persons, and equality before the law, respect for the dignity of every human being, equal opportunities for all individuals and / or groups of individuals. In this regard, the selection of a form of discrimination considers inappropriate. In addition, Article 34 of the Constitution guarantees everyone the right to freedom of opinion and speech, freedom of expression of their views and beliefs. Article 64 of the Constitution says that the constitutional rights and freedoms of man and citizen may not be restricted, except as provided by the Constitution.ImplementationNational Report:
Para 93) The Labour Code of Ukraine was amended in 2015 to specifically prohibit discrimination based on sexual orientation and gender identity in employment and occupation.
Para 94) In 2016, the Ministry of Health abolished its Order No. 60, which foresaw an extensive psychiatric observation of transgender people before undergoing gender reassignment surgery. Instead, the new Order No. 1041 foresees a procedure, in which the extent of the surgical operation is defined by the transgender person.
UN Compilation:
Para 13) ... the HR Committee raised concern about the absence of sexual orientation and gender identity as prohibited grounds for discrimination.
Para 17) The United Nations country team noted that, in 2015, Ukraine had adopted labour legislation prohibiting discrimination on the grounds of sexual orientation, although no criminal sanctions had been foreseen.
Stakeholder Summary:
Para 20) Several stakeholders, while noting that the amendments to the anti-discrimination legislation in 2014 had brought several improvements, expressed concern that the list of protected grounds did not explicitly mention sexual orientation or gender identity. JS15 noted that Parliament voted for the inclusion of sexual orientation and gender identity to the list of protected grounds into the Labour Code. However, Parliament was working on a new version of the Labour Code which did not contain sexual orientation and gender identity among the list of protected grounds. It added that there were no clear mechanisms for filing complaints about discrimination in employment. -
