    Para 81) Thailand attaches importance to eliminating violence against women. Apart from the Protection of Victims of Domestic Violence Act of 2007, additional legal measures have been adopted to further protect women. Recent developments are, among others, the Amendment to Article 397 of the Penal Code regarding the punishment of acts involving sexual harassment or intimidation both in public and domestic realms (effective in February 2015) and the measures to prevent and address sexual violations and harassment in the workplace (approved by the Cabinet in June 2015).

    One notable initiative to promote the rights of women is Her Royal Highness Princess Bajarakitiyabha’s advocacy of the “United Nations Rules for the Treatment of Women Prisoners and Non-custodial Measures for Women Offenders”, or “Bangkok Rules”, which aims to eliminate discrimination against women prisoners by responding to their specific needs. Thailand is in the process of establishing the “Thailand Institute of Justice” (TIJ), which will help promote implementation of the “Bangkok Rules” in all countries. [Para 72]

    Para 69) In April 2020, the Cabinet approved additional measures to prevent and tackle sexual harassment in the workplace. The Department of Women's Affairs and Family Development is also conducting a thorough review of the Prevention and Suppression of Prostitution Act B.E. 2539 (1996) in order to amend the law to suit the modern context, through Focus Group discussions with children and youth, sex workers, relevant government agencies, women and mothers and others.

    Stakeholder Summary:
    Para 34 JS18 highlighted that sex workers continued to be criminalized and subjected to stigma, violence, exploitation, discrimination and marginalisation, as well as were often forced to pay bribes to access basic rights and suffered unfair employment practices.

    While the Act (Prevention and Suppression of Prostitution Act (1996)) treated prostitution of children as an aggravating offence imposing harsher penalties for younger children, it did not exempt child victims of prostitution from penalties under the law. Furthermore, Section 34 of the Act and Section 33 of the Anti-Trafficking Act, a judge was permitted to order a child victim to be confined in a Protection and Occupational Development Centre (PODC) for his 'rehabilitation' for a period of up to two years, which discourages child victims from reporting and has led to many child victims running away during the criminal process.     The protection of the rights of HIV infected persons has been addressed in the National AIDS Strategic Plan (2007–2011). Care and treatment for HIV/AIDS is already covered under the Universal Healthcare Coverage Scheme, in accordance with conditions specified by the Ministry of Public Health. A monthly allowance of 500 Baht is provided by the Government to persons with HIV/AIDS as a means to promote their quality of life. Thailand is also promoting access to treatment for disadvantaged or other marginalized groups, such as prison inmates and migrant workers, with financial support from other sources such as the Global Fund to Fight AIDS, Tuberculosis and Malaria. Thailand continues to promote positive attitudes among public officials, service providers and members of the community toward persons infected by HIV/AIDS so that they are able to access services on an equal basis and can live in the community without being stigmatized and discriminated against.     Explanation
    Thailand supports this recommendation as they are in line with our obligations under international law and policies to promote and protect the rights of vulnerable groups. In addition, Thailand wishes to note that supporting this recommendations, which contains the terms “indigenous”, does not constitute an acceptance that the term “indigenous people” applies to those people belonging to various ethnic groups in the Kingdom who form an integral part of the nation.
