Revise comprehensively its national legislation in order to bring it in line with its Constitution and with CEDAW

Continue to address violence against women including measures to ensure that domestic violence and rapes are duly reported

Ensure the swift implementation and enforcement of legislation criminalizing all forms of violence against women, including domestic violence

Repeal legislation criminalizing consensual sexual conduct between same-sex adults

CESCR urged Tunisia to take targeted measures with regard to women who were at the greatest disadvantage in the labour market, in particular rural women. [Para 60]

JS1 said that prostitutes were also subject to a high level of social stigmatization and were more susceptible to being victims of violence. [Para 70]

Promote and protect children’s rights, in particular prevent child marriage by removing all exceptions that allow for the marriage of those under 18 years of age.

Strengthen further practical measures for the implementation of the CEDAW.

Take necessary measures to implement Law 2017-58 regarding the elimination of violence against women.

The Association Tunisienne de Prévention Positive (ATP+), JS8 and JS9 reported that persons living with HIV are subject to multiple forms of discrimination owing to limited access to HIV care services, stigmatization (including on the part of paramedical and medical personnel) and the non-respect of medical secrecy in hospitals. They recommended eliminating all forms of discrimination against them, in law and in practice, ensuring genuine and free services to provide all HIV-related care, establishing quality local services, training medical and paramedical personnel to observe medical secrecy and respect human rights and introducing into the 1992 law on communicable diseases a rights-based approach, or even adopting a new law. A large number of national bodies and NGOs were involved in the extensive consultations held at the national level in preparing this report. They stressed the need to forge ahead to consolidate the progress made. The following main recommendations were made:
- To continue to promote women's rights and eliminate certain persistent discrimination, in areas such as reservations to the CEDAW, the recognition of equal inheritance rights, the strengthening of legislative provisions on the mother's equal right to pass her nationality to her children, the strengthening of legal provisions penalizing violence against women in general and its recognition in law as a human rights violation, increased awareness of the situation of rural women and of their right to equal opportunities in economic and social matters ...
