Type:RecommendationSession:26th session, November 2016Status:AcceptedContents:Develop and adopt legal and administrative measures to investigate and punish acts of discrimination, stigmatization and violence against LGBTI personsExplanationTimor-Leste attaches great importance to promoting equality and combat discrimination. The Timorese law explicitly prohibits discrimination on the grounds of sexual orientation and gender identity. All the citizens are equal before the law and have the same rights, and public authorities must not discriminate citizens in any ground, included on the basis of sexual orientation and gender identity. -

Type:RecommendationSession:26th session, November 2016Status:AcceptedContents:Ensure access to justice for all the population, especially for victims of sexual and gender violenceExplanationTimor-Leste is strongly committed to combat all forms of gender-based violence. Discrimination based on sex is prohibited by law. Timor-Leste has taken and will continuously take a number of measures to prevent, combat and decrease discrimination and violence based on sex, especially against women. Access to justice is a core fundamental right in the Timorese Constitution. However, it is a right that faces a number of challenges, including a lack of legal aid mechanisms, a lack of rights awareness and poor knowledge about the tools that are available to access to justice. Many actions and programs had already been taken to increase the access to justice, for example, the mobile courts or the recent created Access to Justice Clinics. Timor-Leste will continue working to ensure this right to all citizens, including groups such as children, women and those who lack sufficient resources, especially in the remote areas.ImplementationUN Compilation:
Para 27) The Special Rapporteur noted that, in terms of access to justice and compliance with human rights standards, there were shortcomings in both the formal justice system and the customary justice system. In the customary justice system, hearings were commonly conducted in public, which was clearly unsuitable for crimes relating to emotionally vulnerable victims of domestic violence and child abuse. Some customary justice practices might entail physical punishments, in contravention of international human rights law.
Para 30) … the Committee [against Torture] expressed concern about the absence of any concerted efforts to bring to justice those responsible for the killing or disappearance of an estimated 18,600 people and the more than 11,000 allegations of torture and over 1,000 allegations of sexual violence, including rape and sexual slavery, documented by the Commission for Reception, Truth and Reconciliation.
Stakeholder Summary:
Para 64) JAI … also noted that Timor-Leste had responded to recent criticisms of de facto discrimination against women by affirming its ongoing commitment to ending gender discrimination, promulgating laws to require female representation at the local government level, and approving a new National Action Plan on Gender-based Violence aimed at preventing violence and increasing women’s access to support services and the justice system.
Para 65) AI noted that reports of gender based violence remained high in Timor-Leste, with the last reliable data source being a baseline survey (2015) showing that 59 per cent of women experienced some physical or sexual violence. Accessing justice through the courts system, judicial officers providing lenient sentences and a lack of suitable remedies were cited as ongoing and systemic challenges.

Type:Review DocumentationSession:12th session, October 2011Status:N/AContents:The Ministry of Justice, in conjunction with national and international partners, has been making significant efforts to facilitate the process of registering births, namely by enacting the Code of Civil Registration, providing civil registration services in the thirteen districts, implementing registration outposts in hospitals and launching periodic campaigns for the registration of births, with the aim of achieving universal registration in Timor-Leste. Nevertheless, despite these efforts, most children are still not registered, or are registered late, when they reach school age or adulthood.
