[CEDAW] noted with concern that abortion was not legal, except in cases in which there was a threat to the life of the pregnant woman or where the fetus was shown to have a severe and incurable abnormality, and that doctors had wide discretion to refuse to carry out abortive procedures in those cases. The Committee was concerned that women undergoing an abortion faced criminal penalties, including in cases of rape and consanguinity. Women who sought hospital treatment for miscarriages faced criminalization when hospital staff suspected that they had attempted to access abortion services, especially in circumstances where pregnancies occurred outside of wedlock.
