Algerian family law is based on the provisions of Islamic sharia law.Para 189) The State’s accession to further international instruments is examined within the framework of a constant and gradual process that takes account of the implications of such a step in terms of the consistency and alignment of national legislation and practice.Para 191) … With regard to the reservation entered by Algeria to article 2 of the Convention on the Elimination of All Forms of Discrimination against Women, the Algerian State is committed to implementing article 2, excluding those provisions that are contrary to its family law, taking into account article 37 of the Constitution, which recognizes the principle of equality of the sexes by providing that all citizens are equal before the law, without discrimination as to birth, race, sex, opinion or any other personal condition, where this circumstance can be invoked, or social condition.
