    Noted. it considers that they have already been complied with. Since its EU integration, Romania transposed all six EU Directives and the European acquis in the field of gender equality. The principles of equal opportunities and equal treatment between women and men are transposed in the national legislation, institutional mechanism, public policies and are reflected at civil society level. Important concepts are regulated by the main legal act in the field, such as: direct and indirect discrimination based on sex, sexual and psychological harassment, equal pay for equal work, positive actions, multiple-discrimination, sex, gender stereotype, gender budgeting. The law also includes specific measures for implementing the gender perspective in the labour market, education, eliminating gender roles and encouraging equal participation of men and women in the decision making process. The National Agency for Equal Opportunities between Women and Men was established in 2015 with a role in implementing public policies and strategies; legislative initiatives; data collection; designing and implementing programs and awareness campaigns ; cooperating with central and local authorities and NGOs. Based on the above, Romania reaffirms its commitment to promote gender equality.

    Para 48) As concerns recommendations 3 and 11, during 2010-2011, NCCD has developed, in partnership with the Ministry of Administration and Interior, the project "Training for trainers on preventing and combating all forms of discrimination". The project aim was to inform, educate and raise awareness among police officers on social issues aimed by the actions of various groups vulnerable to discrimination. The Ministry of Administration and Interior has implemented this course as a model of good practice in all counties Police schools of the Ministry and, starting with 1st October 2011, the course "Preventing and combating all forms of discrimination" was introduced within the training programs for the personnel of the Ministry.

    Para 50) During 2010-2011, within the new Strategy in the field of Equal Opportunities between Women and Men for 2010-2012, reunions and meetings were organized, as well as debates on themes such as equal participation of women and men in the decision making process, eliminating gender stereotypes, the role of women in rural areas, the reduction of the gender pay gap. A various palette of participants, such as representatives of social partners, central public administration, NGO's and citizens, attended the events.

    According to Human Rights Watch (HRW) patients living with HIV face discrimination in access to necessary medical services and doctors often refuse treatment to patients living with HIV. Breaches of confidentiality about individuals HIV status are common and rarely punished. HRW added that Romanian law provides for mandatory medical testing for a wide variety of jobs where the risk of HIV transmission is minimal, including hair dressers, beauticians, manicurists, child care staff, medical personnel, food services, and cleaning staff in the tourist industry. Employers and doctors also order ad hoc HIV testing for jobs where testing is not mandatory. HRW recommended that Romania end mandatory HIV testing as a condition of employment and ensure that persons living with HIV are not unnecessarily prevented from working or attending vocational school. HRW noted that in the few instances where the National Council for Combating Discrimination has intervened in cases involving people living with HIV, its interventions were limited to mediation in cases of children expelled from schools, or the imposition of nominal fines which are paid to the government and not to the victim [Para 11].

    Para 88) In the field of domestic violence, the Ministry of Labor and Social Justice, through the National Agency for Equal Opportunities for Women and Men (NAEO), exercises the functions of strategy, regulation, representation and State authority and has attributions in the elaboration, coordination and implementation of the strategies and policies of the Government.
    Para 89) In order to strengthen public policy for eliminating gender based violence, including domestic violence, in 2012, the Romanian Government approved Government Decision no. 1156/2012 for the approval of the National Strategy for prevention and combating of family violence and the Action Plan for implementing the national strategy for prevention and combating of family violence for the period 2013–201726 .
    Para 90) By Law no. 30/2016 Romania ratified the Istanbul Convention imposing concrete measures on States Parties to prevent and combat violence against women and domestic violence. The Istanbul Convention proposes creating mechanisms to guarantee the protection of victims, raise awareness of the effects of the phenomenon, and prevent and combat all forms of violence.
    Para 91) In order to carry out the complex legislative steps required by the implementation of the Istanbul Convention, NAEO elaborated the necessary legislative package for the implementation of the Istanbul Convention, which includes the modification of the legislation regarding equal opportunities for women and men, on the prevention and combating domestic violence, the modification of the Criminal and Criminal Procedure Codes.
    Para 92) At the same time, the Governance Program for the period 2017–2020 provides a series of measures aimed to preventing and combating violence against women and domestic violence, and has as a prerequisite the adoption of the draft laws necessary for the harmonization of national legislation with the provisions of the Istanbul Convention and it will be transposed into secondary legislation, as well as the development of social services for victims of domestic violence and aggressors by implementing projects from European funds.
    Para 93) Another important task of the NAEO is to finance and/or co-finance programs of national interest in the field of gender equality and prevention and combating domestic violence. A number of projects were and are to be developed in order to raise awareness on this phenomenon.
    Para 95) Aspects related to domestic violence are being approached in the framework of the family law organized for the judicial trainees and for the continuous training by the National Institute of Magistracy.
