With a view to the advancement of the historically marginalized sectors of society, article 191 of the Constitution establishes quotas for gender representation and for representation of the peasant and indigenous communities and native peoples in regional councils; the same applies to municipal councils. This quota system is one of the mechanisms used by the State to assist groups or sectors subject to discrimination that need such measures to promote and ensure their participation; such preferential treatment can be objectively and reasonably justified. Another key aspect of increasing and improving indigenous peoples' involvement in regional and local public affairs is the introduction of participatory budgeting, a democratic mechanism through which indigenous representatives can present their needs and demands in order to obtain public funds. The HR Committee and the CRC asked about the steps taken to ensure birth registration and access to identity documents for all children born in Peru, particularly those born in the border areas of the Amazon Basin, Indigenous children, children living in rural or remote areas and migrant, refugee and asylumseeking children. CEDAW recommended that Peru remove the requirement of parents’ official documentation for the issuance of birth certificates and ensure that birth certificates were issued to all children born in Peru. ECLJ recommended that Peru allocate resources and training for authorities to be able to effectively investigate cases of human trafficking and sexual exploitation. [Para 43]

Continue to develop appropriate prison facilities for women, in accordance with the UN's Standard Minimum Rules for the Treatment Female Prisoners and Non-Custodial Measures for Women Offenders.

Ratify the Optional Protocol to the International Covenant on Economic, Social and Cultural Rights (OP-ICESCR).

Ensure full recognition of sexual and reproductive rights through access to comprehensive sexual education. Public health sector should take into account violations of sexual freedom and the importance of precocious pregnancies in the country, and combat discrimination related to socio-economic conditions.
