En respeto a la independencia y autonomía de las Entidades, sobre “dejar de apelar sentencias judiciales”, se resalta que la interposición de un medio impugnatorio obedece estrictamente al ejercicio de un derecho que le asiste a los órganos del Sistema de Defensa Jurídica encargados de representar a las entidades, al formar parte de un proceso judicial (en virtud al emplazamiento realizado por la autoridad judicial), ante la existencia de un fallo que involucra las funciones de la institución, con el objeto que el superior jerárquico efectúe el control eficaz de la resolución judicial expedida en primera instancia. Es a esta consideración y no a otra, a la que se ciñe la actuación recursal de las Procuradurías Públicas, las misma que cuenta con una actuación de naturaleza autónoma y estrictamente jurídica.

In December 2007, UNDP - Peru, the Joint United Nations Programme on HIV/AIDS (UNAIDS) and the Peruvian Press Council launched a nationwide campaign to combat stigmatization and discrimination against people living with HIV. The campaign had significant national and regional impact.
Similarly, in labour law, discrimination against people with HIV/AIDS is prohibited. Article 25, paragraph 17, of the General Labour Inspectorate Act, Supreme Decree No. 019-2006-TR, stipulates that discrimination against HIV-positive employees, inter alia, is a very serious violation of labour law. Para 39) Moreover, Legislative Decree No. 1323 bolsters efforts to combat femicide, domestic violence and gender-based violence by redefining the criminal offence of sexual exploitation and establishing aggravated penalties (from 20 to 25 years), significantly harsher than those for other criminal offences, when the victim is a child or adolescent. It also establishes a custodial sentence of not less than 25 years and not more than 30 years in the event of the victim’s death.
Para 97) The National Programme to Combat Domestic and Sexual Violence is responsible for prevention policies and policies for the care and support of persons involved in gender-based violence, particularly domestic and sexual violence, directed against women and members of the family.
